The Code of school says that it is his jurisdiction to
entertain his application file that former National security adviser: Retired Col. Sambo Dasuki allege volitional
office fundamental human right. This follows the preliminary objection file by
the Federal Government challenging the jurisdiction of the code to entertain
the matter.
Judiciary correspondent report says that retired Col. Sambo Dasuki has last month
approached the ECOWAS Court to challenge his continuous detention that the Department
of State Services (DSS). Behold, according to his council was to enforce his fundamental
human right as assured in African Chatter of human and people’s right.
However, council to the federal government MR. TIJANI GAZANI opposed the
application, arguing that the ECOWAS Court lack jurisdiction to entertain the
matter since it was before Nigeria court. Mr.
Tijani urges the Court to declare the Jurisdiction and the matter and
dismiss the application. It is really Justice Eke say that the court has the
jurisdiction to attend to cases of alleged law violation of individuals within
member state. Justice Nwoke further
stated that the case before Nigerian court was a criminal matter while the
application file before it that Dasuki
was based on his alleged human right violation. He said the objection of the
jurisdiction of the court was confounded since the case was on human right and
it was not before any international court.
The council to the federal government of Nigeria Mr. Tijani Gazani expressed his readiness to justify why Dasuki was still in Detention. According
to a report that African chatter on human and people’s right is not only about
right but to include duties, and therefore it is the duty of every Nigeria not
to compromise the office of the security of the nation. The council to Col. Dasuki Chief Robert expressed
satisfaction of the ruling. In the main time, the case has been adjoin to the 17th and 18th of
the next month for hearing.
